Terms of Service

These Terms of Service ("Terms") govern your use of the Ching Ching mobile app and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

The Service is intended only for users aged 18 and over. By using the Service you confirm that you are at least 18, that the information you provide is accurate, and that you will keep your account credentials secure. You are responsible for all activity under your account.

2. Your account

You must register with a valid email address. You may not impersonate others, create an account on behalf of someone else without authorisation, or use the Service if we have previously suspended or banned you. We may refuse, suspend or terminate accounts that violate these Terms.

3. Acceptable use & content

You are responsible for the content you stream, post, send or share ("User Content"). You must comply with our Community Guidelines, which form part of these Terms. You may not use the Service to post or transmit content that is illegal, sexually explicit, exploitative of minors, hateful, harassing, violent, deceptive, infringing, or otherwise prohibited by the Community Guidelines.

If you believe content on Ching Ching infringes your copyright, tell us: the notice you need to send, what we do with it, and how to counter a takedown are set out on our Copyright and takedowns page. We remove infringing content and close the accounts of repeat infringers.

You retain ownership of your User Content. You grant Ching Ching a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and distribute your User Content as necessary to operate and promote the Service. This licence ends when your content or account is deleted, except for content others have shared or that we must retain by law.

4. Coins, gifts and purchases

Ching Ching uses a virtual currency ("Coins"). Coins and virtual gifts are a limited, non-transferable, revocable licence to a feature of the Service. They have no monetary value, cannot be exchanged for cash by viewers, and are non-refundable except where required by law or the app store's policies. All purchases (Coins, gifts, paid streams and subscriptions) are processed by Google Play Billing (Android) or Apple In-App Purchase (iOS) under their respective terms.

5. Creator earnings and payouts

Creators may earn from gifts, paid streams and subscriptions. Earnings are credited to your creator balance subject to our review, a holding period, and any platform and processing fees. Payouts are made to a verified payout account through our payment partner once you meet the minimum threshold. You are responsible for any taxes on your earnings. We may withhold or reverse earnings linked to fraud, chargebacks or policy violations.

6. Prohibited conduct

• Violating the Community Guidelines or any law.
• Attempting to manipulate Coins, gifts, balances, view counts or payouts.
• Reverse engineering, scraping, or interfering with the Service or its security.
• Harassing, threatening, or infringing the rights of other users or creators.

7. Moderation, suspension and termination

We may remove content, limit features, or suspend or terminate accounts that violate these Terms or the Community Guidelines, with or without notice where appropriate. You may stop using the Service and delete your account at any time from Settings → Account (see our account deletion page).

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not endorse and are not responsible for User Content. We do not guarantee that the Service will be uninterrupted, secure or error-free.

9. Limitation of liability

To the maximum extent permitted by law, Ching Ching will not be liable for any indirect, incidental, special or consequential damages, or for lost profits, data or goodwill, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Governing law

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-laws rules. Disputes will be subject to the competent courts of Rotterdam, unless mandatory consumer law gives you the right to bring proceedings elsewhere.

11. Changes to these Terms

We may update these Terms from time to time. We will post the new version here and update the "Last updated" date above. Significant changes may also be notified in the app. Continued use of the Service after changes take effect means you accept the updated Terms.
